Russell
& Mallett, LLP was founded to provide prompt, personal and affordable
legal services to our clients.
We
prepare, interpret and amend governing documents, vendor and management
contracts, design and construction repair specifications, association books,
records and minutes, and we possess a thorough knowledge of the law affecting
community associations. We provide practical
advice which is easily understood by community association boards and their
members.
We have substantial experience in construction defect and general litigation
affecting community associations. This
ranges from actions to enforce the Governing Documents and rules, to complex
construction defect disputes and defending associations and directors from
property damage and personal injury claims. We
have been involved with claims arising out of vendor contract disputes and have
represented associations before various city, county and state agencies.
We can also assist the association with implementing major repairs with
coordination of design professionals, contractors, manufacturers, association
members and tenants.
Since
1987, Larry Russell has represented community associations and their Boards of
Directors in resolution of complex construction defect matters. Our
clients recover the funds to repair their projects together with a cohesive plan
for repairs and reconstruction. This
approach is derived from the many years Larry Russell
spent with Fluor Engineers & Constructors, Inc., working with teams of
engineers and experts to build complex construction projects around the world.
The
firm is active in all organizations which assist homeowner associations,
including Community Associations Institute, California Association of Community
Managers, Council of Condominium Homeowners Associations and the Executive
Council of Homeowners. The firm has contributed numerous articles and publications to
these organizations, and frequently lectures about issues concerning the
community association industry.
We
keep our clients abreast of pending legislation affecting community
associations, and provide up to the minute information concerning the status and
hearing dates of this legislation and its impact on our homeowner association
clients.
